Ford settled a class action lawsuit in Sacramento and then proceeded to lie to the public and media, claiming that the settlement ended all outstanding lawsuits against Ford stemming from Explorer rollovers, which would include all lawsuits for personal injuries and wrongful deaths. No Right to Sue an Employer in Court for Personal Injuries at Work

Under California law, like most states, when an employee is injured in the course of employment, as a result of the negligence of the employer, a co-employee, or the employee,  the injured employee is not allowed to sue the employer for personal injuries in the Superior Court. When a personal injury is caused by someone other than the employer, the injured employee can sue the third party in the Superior Court and simultaneously obtain workers’ compensation benefits. Drivers injured on the job by the negligence of others or workers injured by defective/toxic products have both third party and workers’ compensation rights. Drug Manufacturers, Medical Devices, Personal Injuries and Wrongful Deaths

When drug manufacturers are sued for refusing to properly label products that have resulted in personal injuries or wrongful  deaths, they argue that under state laws personal injury claims are barred under the doctrine of federal preemption. When a court orders that a claim is subject to federal preemption it precludes the defendant from being held responsible under state laws. Once preemption is granted against drug manufacturers injured plaintiffs are denied any forum to litigate their claim and are precluded from obtaining any compensate for the damages they have suffered. This is because no federal law or regulation exists which allows recovery for such claims in federal courts. A plaintiff who was injured as as result of some negligent conduct on the part of a defendant is entitled to recover compensation for such injury from that defendant. A plaintiff is entitled to a verdict if jury finds 1. “Cable barriers” do nothing to prevent cross median crashes, which always result in wrongful deaths and extremely serious personal injuries. A cross-median head-on crash is the equivalent of hitting a concrete wall at 130 mph and with cars designed to absorb an impact of 30-35 mph, the results are inevitable.
