We have an accident case which has our $50,000 limit for (under-)insurance. A 15-passenger van of people from a church in LA was on a road trip, the old, untrained driver made an illegal u-turn across our lane on Highway 29, Kelseyville. My family was on the way to Church on Father's Day, June 15, 2008, driving at 50 mph, and struck the van broadside. Airbags saved our lives. I was driving; my husband, in the passenger seat, somehow missed the air bag and broke the windshield with his head, causing severe brain (& chest) trauma, tooth and jaw damage. After one year, he is slowly recovering, and lost partial function of his right hand. He is an extraordinary Artist (watercolors - see web album link); and Leszek has been unable to paint as he did, since the accident. My son (age 18) was in the back seat, was going into the Marines after High School, suffered a herniated disc and is still under treatment. Due to PTSD, I have been unable to return to my regular job as a legal secretary. Insurance limits for the wrongful driver of the Van were $30,000, which has been offered. However, we discovered that a Class B license may have prevented the crash. The driver did not have a Class B license, and the rental company rented a van for more than 12 people on a 1,000+ mile trip. The Church has an insurance company, but our present attorney has not sent any notice of our accident and possible liability. Same with the rental car company, which is a huge Fleet. We only have insurance money on the table. The driver is poor. Do you think we have a case to file a lawsuit here in Lake County or in Los Angeles where the driver lives? Our present attorney will not file any lawsuit and wants to settle for the insurance money, exonerating the driver. After medical expenses, we would end up with about $25,000 for our family. Will you call me at 707-279-8886 about possible representation? Thank you.
